Eminent Domain by the Back Door contains the wishful thinking that there is some groundswell of ground-level opposition to strict land-use law and that limitations on eminent domain "... could be only the opening shot" in limiting regulation.
What private property enthusiasts ignore is that in general the people who wish to develop property are far, far fewer than those who simply wish to protect their existing interests. The latter group -- those who seek protection of the value of their already-developed property -- illustrate the root motivation for land use law and illustrate why it will roll merrily along. It's not the state which wishes to limit the use of your property. In general, it's your neighbors.
